A) All property to be transported shall, unless otherwise in writing agrees, be held, carried, and delivered subject to the

conditions of the regular current form bill of Lading of the Carrier - (for exception, see paragraph C).

B) In the event of loss and/or damage, the carrier's liability shall not be for a greater value than the maximum specified in the

carrier's bill of lading, unless a greater value is shown on shipping receipts and bills of lading and extra freight paid thereon in

accordance with Rule No. 4.

C) Shippers may, at their option, take advantage of the higher rates provided under Rule No. 4. Such declaration of intent must

be made on delivery of shipments to the carrier on shipping receipts and bills of lading. Unless shippers specifically declared

that it shall be deemed that the shipper elects that goods be carried at the lower rate, subject to all terms of the carrier's current

bill of lading as to limitations of value, liability, and otherwise.

D) When used or endorsed on intermodal bill of lading, the works "on board" shall mean on board the original carrying vessel

when the goods or packages are being transported to Canada, but when the goods or packages are being transported from Canada

"on board" shall mean and include on board a rail car or chassis operated by a participating carrier and en route to the port of loading

for loading aboard Carrier's or participating carrier's vessel. In the case of any On Board endorsement, the naming of an ocean vessel

in the bill of lading is for convenience and is not a representation. that the goods will be loaded to such vessel.
